Should texting while driving be a primary offense that police can

  1. Yes.
  2. No, keep it a secondary offense where you can get a ticket for texting but only if you are stopped for something else.

I agree the penalty should be severe. I also suggest the penalty should be even harsher for police officers caught in the act. Who here has not seen them distracted ....on the phone, texting or looking down at their computer while driving. After teenagers the police are the next biggest abusers.

Not only should texting be a primary offense, so should talking on a cell phone. Not just hands on, but hands off also. All three are dangerous on the road.

Texting and driving is very dangerous and steps should be taken to stop it. Making it primary offense fine but will not make a huge difference. The phone can only be obtained to prove what the parson was doing with consent or a warrant. The best solution is no tolerance polices for the violations the texting causes such as lane violations which are much easier to prove in court.
