Appeal denied for condemned Fla. killer Gore

September 26, 2013

MIAMI (AP) — A Miami federal judge has denied the latest appeal by convicted killer Marshall Lee Gore, whose execution by lethal injection is set for next week.

U.S. District Judge Donald Graham ruled Thursday against Gore, who has had three previous execution dates delayed this year. Graham agreed the Florida Supreme Court was reasonable in finding that Gore's claims of insanity are unfounded.

Gore was sentenced to death for the 1988 killing of exotic dancer Robyn Novick, whose body was found in rural Miami-Dade County. He was also sentenced to death for the separate slaying earlier in 1988 of Susan Roark in north Florida and was convicted of attempting to kill yet another woman.

Barring a last-minute stay, the 49-year-old Gore's execution is scheduled for 6 p.m. Tuesday.
