CAM or Not?
January 28, 2013 - Sylvia Heldreth
If a licensed Community Association Manager helped an association by supervising the lien filing process on a delinquent owner, he or she would be engaged in the unauthorized practice of law. The legislature and the attorneys explain that filing liens is not as simple as it seems and that the things that need to be considered or that could go wrong really require the process to be supervised by a licensed attorney. We've even heard it said that individuals who represent themselves have a "fool for a client."
Should a CAM be able to handle this type of legal process?
What do you think?
