Some, especially smokers, say that a person's "home is his castle" and smoke is like cooking odors, something one has to accept when living in a community with others. On the other hand, six California cities and counties have banned smoking in all condo units. A Florida court awarded $1000 to a nonsmoker after she successfully argued that her condominium neighbor's smoking was trespass, a nuisance, and violated her right to quiet enjoyment.
